These terms of use, as amended from time to time ("terms"), are a binding contract between OUTBACK ADVENTURES TV PTY LIMITED TRADING AS MY OUTBACK TV ABN 17 134 421 766 ("we") and you ("you"). You must read and agree to these terms, including the privacy policy, before using the myoutback.tv website (the "site") or any applications, features or functionality available on or through the site (collectively, the "service"). By using the service, you agree to these terms. If you do not agree to these terms, do not use the service.

By using or accessing the myoutback.tv service, you represent, warrant and agree that you will not include any content that is:

• untrue, misleading, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive to another person's privacy or protected data, hateful, or racially or otherwise objectionable;
• infringing upon a third party's intellectual property rights, including any patent, trademark, trade secret, copyright, right of publicity, including any content that is the subject of any claim of infringement;
• of a type that you do not have a right to transmit under any law or under contractual or fiduciary relationships, such as proprietary and confidential information;
• unsolicited, undisclosed or unauthorized advertising;
• software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
• data or information obtained through access that was not authorized by the owner, or that you are not authorized to post; or
• in violation of any policies posted to the site;
• in violation of any applicable local, state, national or international law (including export laws).

By using or accessing the myoutback.tv service, you represent, warrant and agree that you will not Post: User Content that violates the law or anyone's rights, including intellectual property ("IP") rights or other proprietary rights (such as rights of publicity and privacy); any Contact Information or private information of any third party; false, misleading or fraudulent information; any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer or telecommunications equipment; alcohol-related or other mature content on Pages on the myoutback.tv service that have not set appropriate age based restrictions (based on the country in which the page will be viewable); or User Content that is threatening, hateful, racially or ethnically offensive, or that depicts nudity, pornography or graphic or gratuitous violence, or anything else that we may consider offensive.

myoutback.tv has the right and will exercise all such rights to pre-screen, review, edit or approve any User Content. Myoutback.tv may, in its sole discretion, remove or disable access to any

User Content.
"User Content" means any photos, text, link, audio, video, designs, ads and anything else that you Post on or through the myoutback.tv service. "Post" means to upload, post, transmit, share, store, link to or otherwise make available on or through the myoutback.tv service. the above.

By uploading and/or submitting any User Content, material and or information which is intellectual property, including but not limited to copyrighted works and trade marks (the “intellectual property”) onto myoutback.tv, you are granting myoutback.tv a perpetual, worldwide, payment free, royalty-free, freely transferable, freely sub licensable (through unlimited levels of sublicense), non-exclusive license to use, exploit, reproduce, modify, transmit, distribute, publicly perform and display (including in each case by means of a digital audio transmission), advertise in, on, and around, and create derivative works of the intellectual property, and to incorporate such intellectual property into other works in any form, media, or technology now known or later developed, in any jurisdiction in which the myoutback.tv service is available to users. This license includes the right of other users of the site to download and view your User Content on their own computers.

"User Content" includes any photos, text, link, audio, video, designs, ads, stories, suggestions and anything else that you Post on or through the myoutback.tv service. "Post" means to upload, post, transmit, share, store, link to or otherwise make available on or through the myoutback.tv service.

With respect to User Content other than photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the service including forum posts and video comments (collectively, “Interactive Content”),you hereby grant myoutback.tv an irrevocable, perpetual, worldwide, payment free royalty-free, freely transferable, freely sub licensable (through unlimited levels of sublicense), non-exclusive license to use, exploit, reproduce, modify, transmit, distribute, publicly perform and display (including in each case by means of a digital audio transmission), advertise in, on, and around, and create derivative works of the Interactive Content, and to incorporate such Interactive Content into other works in any form, media, or technology now known or later developed in any jurisdiction in which the myoutback.tv service is available to users.

You also hereby waive any moral rights you may have in such Intellectual Property and User Content and Interactive Content under the laws of any jurisdiction. We may (but are not obligated to) display your User Content, including your username and your actual name (according to the preferences you select).

If you own or control a website, you may place myoutback.tv's share link button, logo and/or text (a "Share Link"), including all trademarks therein, on your website for the sole purpose of enabling users to Post links or content from your website on the myoutback.tv service. By offering a Share Link on your website, you agree, represent and warrant that you will not place a Share Link on any page containing content that would violate these Terms if Posted on the myoutback.tv Service. The rights granted in this paragraph may be revoked by us at any time in our sole discretion, and upon such termination, you will immediately remove all Share Links from your website.

With the exception of Interactive Content, you may remove or modify Content that you post on the Site. If you want to remove a video, please provide your user name and password and the video will be removed in 5 business days. If prior to receiving your removal request, myoutback.tv has distributed, or developed specific plans to distribute, any electronic, printed, or other materials containing such Content (e.g., in advertising, promotion or otherwise), then myoutback.tv has a limited right to continue to distribute those materials. If you want myoutback.tv to stop distributing the materials, simply send us written notice to stop distributing such materials, in which event we will stop distributing the materials within 30 days. Your notice must be signed by you, include your telephone number and email address, and be sent by first class mail, postage prepaid, to MY OUTBACK TV PTY LIMITED, PO Box 728, Oxenford, QLD 4210, Attn: Website Administration.

In addition, the notice must clearly identify the Content at issue, describe the specific use of the Content you wish to end, and contain statements that you own or have an exclusive right to the Content and that all the information in the notice is true and correct. The 30 day period for myoutback.tv to stop distributing your Content begins only once myoutback.tv has received a notice complying with the requirements of this. Note that users of the Site that have downloaded your Content may continue to view and use that Content not withstanding myoutback.tv’s removal of Content from the Site.

myoutback.tv may immediately terminate your access to the myoutback.tv Service at any time without giving any explanation or justification for the termination of access, and myoutback.tv will have no liability for any costs, losses or damages of any kind arising as a consequence of terminating your access.

When you submit ideas, suggestions, feedback, documents, proposals, or information you provide (collectively, "Submissions") to myoutback.tv through our content submissions web pages located at on our web site, you represent, warrant, acknowledge, and agree that:

• your Submissions do not include confidential or proprietary information;

if we so choose, myoutback.tv may use and disclose your Submissions in any way; and myoutback.tv has no obligation to pay or reimburse you for your Submissions or our use of your Submissions.

We care about the privacy of our users and encourage you to read our Privacy Policy

We respect the privacy rights of third parties, and you must do so as well on the myoutback.tv Service.

If you collect, access or use information relating to any user of the myoutback.tv Service (including information contained in any user profile) you must obtain consent from the user and make it clear to the user that the collection, access and use is being carried out by you and not myoutback.tv.

Advertisements and other information provided by third parties may not be wholly accurate. myoutback.tv is not responsible or liable for (i) the availability or accuracy of such sites or advertisements; or (ii) the content, products or services available from such sites. The inclusion of any link on the Service does not imply that we endorse the linked site. You use the links at your own risk. myoutback.tv's Privacy Policy is applicable only when you are on our Site. Once you link to another website, its privacy statement applies to any personal information you supply.

Transactions with Third Parties. Your transactions and other dealings with third party merchants or advertisers that are found on or through the Service, including "click to purchase," “co-registration,” and other similar programs, including payment and delivery of related goods or services, are solely between you and such merchant or advertiser.

The myoutback.tv directory service allows members to buy advertised goods and services related to outback lifestyle which will appear in the various on-line directories or on-line directory sub-pages found at http://www. myoutback.tv. Some products listed are provided by our merchant partners for whom we list their products as a service. Customers should refer to the specific terms and conditions provided by each merchant.

Each product or service will be separately paid for using the myoutback.tv payment gateway (which is accessible to logged in directory members) which will appear on the invoice. Payments for listings must be made through the myoutback.tv directory payment page.

Once goods or services are paid for by a member, the relevant products will be delivered in accordance with our delivery terms in the case of physical products. Where a member purchases digital form products, then the invoice provided shall provide a link to a web site URL from where those products may be downloaded. Members who buy products will receive a receipt after the payment process is complete and should print this off into hard copy for future reference. Logged in directory members are also able to view their transaction history.

myoutback.tv attempts to be as accurate as possible. However, myoutback.tv does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by myoutback.tv itself is not as described, your sole remedy is to return it in unused condition.

When purchasing from myoutback.tv your financial details are passed through our secure server using the latest 128-bit SSL (secure sockets layer) encryption technology and it is again encrypted using encryption algorithm which is at least 64-bit. Please refer to our Security Policy for complete details.

All transactions are in Australian Dollars.

Delivery time takes up to 10 working days from the date your payment is received. Please note that BPAY payments take 1–2 business days to process. Customers should be aware that individual merchants listing products on the myoutback.tv web site may have delivery terms that vary form these standard delivery times and customers should acquaint themselves with all terms of sale provided by each merchant.

Where you have purchased a Product that is dispatched from our overseas warehouse, delivery time after payment processing may take up to 3 weeks.

In all instances estimated delivery times will be displayed at the check out for your Product.

myoutback.tv makes every effort to deliver your Product according to the estimated delivery times provided by myoutback.tv at checkout. The estimated delivery times are in business days (Monday through Friday) excluding Public holidays.

Although every effort is made to ship your Order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. If your Product has not arrived after the estimated delivery time, please Contact Us

We encourage you to visit the "Your Account" section on our website to view the delivery status of your Products.

Unless otherwise agreed by us, we will deliver your Products to the address indicated on your Order Confirmation. If no-one is available to take delivery of your Products, our carrier will leave a card so you can pick-up your Product from your local Post Office. Where delivery is by our courier service and no-one is available to take delivery, they will leave a card requesting you to telephone them to arrange a suitable time and date for delivery.

Pricing:
All pricing for shipping and handling are in Australian dollars.

Shipping:
Shipping fees will be charged, in addition, to the cost of your products. Shipping costs are shown at the point of checkout unless otherwise indicated.

Once we receive your order, full details of all costs unless otherwise stated will be emailed to as an invoice. Where any order relates to costs that need to be separately identified then you will be sent an email confirming all such costs.

Certain third party suppliers on the myoutback.tv web site may have their own terms and conditions for the supply and shipment of products. myoutback.tv takes no responsibility for these arrangements and any purchases with such suppliers will be subject to acceptance of their individual terms and conditions.

Shipment destinations are provided at checkout.

If for any reason we are unable to dispatch your orders we will notify you within 2 working days by email. Whilst we will make best endeavours to ensure such notice is also given by 3rd party suppliers, myoutback.tv can take no responsibility for the notice to be given by our 3rd party suppliers however we will be making best endeavours to follow through on all such matters.

Export restrictions:
Unless otherwise stated there are currently no export restrictions over our products however buyers are required to read the terms and conditions provided by individual third party suppliers on the myoutback.tv web site to check if any such restrictions apply to the products offered by these 3rd parties.

Taxes:
No allowance has been made for taxes or other charges applicable to your locality.

We have no obligation to provide you with customer support of any kind. However, we may provide you with customer support from time to time, at our sole discretion, if you have created an account and you submit your customer support questions using your Account.

Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such cases, myoutback.tv's liability will be limited to the fullest extent permitted by applicable law.

In no event will the total aggregate liability to you of myoutback.tv entities or of their licensors or suppliers for all damages, losses, claims and causes of action arising out of or relating to these terms or your use of the myoutback.tv service, including without limitation your interactions with other users of the myoutback.tv service (whether in contract, tort including negligence, warranty or otherwise) exceed the amount paid by you, if any, to myoutback.tv during the twelve months immediately preceding the day the act or omission occurred that gave rise to your claim.

These Terms will be governed by and interpreted in accordance with the laws of Australia, and you agree to submit to the jurisdiction of the courts of Queensland to determine any dispute arising out of these Terms.

You will at all times indemnify and keep indemnified myoutback.tv, and its respective officers, employees and agents (in this paragraph referred to as “those indemnified”) from and against any loss (including reasonable legal costs and expenses) or liability incurred by any of those indemnified arising from any claim, demand, suit, action or proceeding by any person against any of those indemnified where such loss or liability arose out of, or in connection with, or in respect of any breach of these Terms by you, and publication of or distribution of the User Content, material and or information supplied by you.

Myoutback.tv has no obligation to be involved in or mediate or help resolve any disputes between Users.

The "myoutback.tv Service" means the features, services and properties that myoutback.tv makes available through

(a) www. myoutback.tv or any other myoutback.tv-branded or co-branded website (including, without limitation, any and all sub-domains and all international, mobile versions and successors thereof),
(b) the myoutback.tv Platform and
(c) other media, devices or networks now existing or later developed.
Unless otherwise specified, the terms "includes," "including," "e.g.," "for example," and other similar terms used herein are deemed to include the term "without limitation" immediately thereafter. Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision in that or any other instance. If, for any reason, any provision of these Terms or portion thereof is rendered invalid or unenforceable, the remainder of these Terms will remain in full force and effect and will be enforced to the maximum extent permissible so as to effect the intent of the parties. An arbitrator or court will substitute or rewrite any invalid or unenforceable term or provision to make such term or provision valid and enforceable. All communications and notices to be made or given pursuant to these Terms will be in the English language. You consent to receiving communications and notices from myoutback.tv at the email address you provide in registering for the myoutback.tv Service. These Terms constitute the entire agreement and supersede any prior agreement between you and us regarding your use of the myoutback.tv Service.
